Terms and Conditions of Use - WiSense

These Terms and Conditions of Use, hereinafter referred to as the “Terms,” govern access to and use of the WiSense mobile app, hereinafter referred to as the “App.”
The Application is published by WI SMART CONSUMER, SAS, a simplified joint-stock company with a share capital of 266,057.00 euros, registered with the Lyon Trade and Companies Register under number 850 903 022, with its principal place of business located at Immeuble Le Kiaora, 50 avenue Chanoine Cartellier, 69230 Saint-Genis-Laval, hereinafter the “Publisher.”
The technical service provider that develops, maintains, hosts, or technically operates the Application acts on behalf of the Publisher. It is not a party to these Terms of Use with respect to end users, unless otherwise stipulated in a contract entered into directly with it.
1. Purpose of the Application
The Application allows authorized users to access—based on their permissions—information and features related to sites, buildings, lots, equipment, sensors, dashboards, calendars, notifications, documents, and monitoring metrics.
The Application is intended for professional use or for use by individuals authorized by the Publisher or by the organization that manages the relevant site. It is not intended for children or the general public without authorization.
2. Acceptance of the Terms of Use
By creating an account, logging in, or using the App, you agree to these Terms of Use. If you do not agree to the Terms of Use, you must not use the App.
The Publisher may update the Terms of Use. The applicable version is the one published on the Publisher's website or made available in the Application.
3. User Account
Access to the Application requires a user account or access rights granted by the Publisher, an administrator, or the organization responsible for the site.
You agree to:
- provide accurate information,
- keep them up to date,
- Keep your login information confidential.
Any action taken through your account is presumed to have been taken by you, unless proven otherwise.
You must promptly notify the Publisher in the event of loss, theft, disclosure, or unauthorized use of your login credentials.
The Publisher may suspend or delete an account in the event of misuse, a security risk, a request from the organization responsible for the site, or a violation of these Terms of Use.
4. Access Rights and Scope of Use
The information displayed in the App depends on the permissions associated with your account. You should only access the sites, data, and features for which you have permission.
It is prohibited to attempt to access an account, website, device, dashboard, data, or feature without authorization.
You agree not to:
- circumvent access controls or security measures;
- disrupt, overload, scan, or attack the Application or its infrastructure;
- extracting large amounts of data without authorization;
- use the Application for any unlawful, fraudulent, or malicious purpose, or in a manner that infringes on the rights of third parties;
- transmit files that are dangerous, illegal, misleading, or infringe on intellectual property rights;
- resell, rent, sublicense, or make the Application available to an unauthorized third party.
5. Data, Sensors, and Dashboards
The data displayed in the Application may come from sensors, PLCs, monitoring systems, dashboards, manual entries, or services configured by the Publisher.
This data is provided for informational purposes, operational monitoring, and decision support. It may depend on the availability of equipment, networks, sensors, third-party services, and the quality of the configuration settings.
Unless the Publisher has made a specific written commitment, the Application does not constitute:
- a personal safety system,
- an emergency alert system,
- a certified regulatory diagnostic tool,
- a single source on which to base a critical decision.
The user must verify important information using appropriate methods before taking any critical action.
6. Notifications
The app may send notifications regarding sites, equipment, alerts, schedules, or operational information. You can manage notification permissions through your device's settings.
Whether a notification is received depends, among other things, on the device, the operating system, the network, Apple or Google/Firebase services, and user settings. The Publisher does not guarantee that every notification will be received immediately or without fail.
7. Camera, Files, and Added Content
The app can use the camera to scan a QR code and, when this feature is available, take a photo to attach to a file. It can also allow you to select a photo, image, or document from your device.
You are responsible for the content you add to the App. You warrant that you have the necessary rights and agree not to transmit any content that is illegal, confidential without authorization, defamatory, offensive, misleading, or that infringes on the rights of third parties.
The Publisher may remove or have removed any content that is clearly illegal, dangerous, in violation of these Terms of Use, or unnecessary for the service.
8. Third-Party Services and External Access
The Application may integrate with or open third-party services, including dashboards, monitoring tools, automation systems, email services, hosting providers, push notification services, Apple, Google, or Firebase.
These services may be subject to their own terms and privacy policies. The Publisher remains responsible for ensuring that the services it configures are consistent with the Application's scope of use and users' rights.
Apple and Google are not the publishers of the App and do not provide support for it, unless otherwise required by law or as specified in the terms and conditions of their respective platforms.
9. Availability, Maintenance, and Upgrades
The Publisher strives to keep the Application accessible and functional. However, access may be interrupted or impaired, particularly in the event of:
- maintenance,
- update,
- technical issue,
- cyberattack,
- network outage,
- unavailability of a service provider,
- force majeure,
- failure of external equipment.
The Publisher may update, correct, suspend, or remove all or part of the features, subject to any contractual obligations it may have.
10. Safety
The user must:
- use a reasonably secure terminal,
- keep their system up to date,
- protect access to their device,
- Do not share your login credentials.
If an incident, unauthorized access, incorrect data, or unusual behavior is suspected, the user must promptly contact the Publisher at the following address: france@wismartconsumer.eu.
11. Intellectual Property
The Application, its interface, software components, trademarks, logos, text, graphics, and other elements are protected by applicable intellectual property rights.
No ownership rights are transferred to the user. The user is granted only a personal, limited, non-exclusive, non-transferable, and revocable right to use the Application in accordance with these Terms of Use.
12. Liability
The Publisher is liable for the Application to the extent provided by law and by the applicable contracts.
The Publisher shall not be held liable for damages resulting from:
- improper use of the Application;
- unauthorized access due to user negligence;
- incorrect, incomplete, or unavailable information from equipment, sensors, networks, third-party systems, or external settings;
- an interruption, delay, or unavailability beyond its control;
- a critical decision made without proper verification;
- content added by the user or by an authorized third party.
When the Application is provided in a professional or contractual context, the limitations and exclusions of liability set forth in the contract entered into with the Publisher or the organization responsible for the site may also apply.
13. Personal Information
The processing of personal data carried out in connection with the Application is described in the privacy policy.
Users can request that their account be deleted from the app or the web platform after logging in, when this feature is available.
14. Termination and Account Deletion
You may stop using the App at any time. When this feature is available, you can request that your account be deleted from the App's settings or the web platform after logging in.
The Publisher may suspend or terminate your access in the event of:
- violation of the Terms of Service,
- security risk,
- termination of the contractual relationship,
- request from the organization responsible for the site,
- legal requirement.
Deleting an account does not necessarily result in the immediate deletion of all data related to sites, equipment, documents, or historical records, when retaining such data remains necessary for operations, evidence, security, maintenance, or compliance with legal or contractual obligations.
15. Governing Law and Disputes
These Terms of Use are governed by French law.
In the event of a dispute, the user is encouraged to contact the Publisher to seek an amicable resolution. If no resolution can be reached, the dispute will be subject to the jurisdiction of the competent courts in accordance with applicable rules.
